Purchase rules
1. General Provisions
1.1. These rules of purchase and sale of products
(further „Rules“) is for all sides necessary lawful document, which defines Customer
and Vendor rights and responsibilities, purchasing and paying for products conditions,
product delivery and return conditions, all sides responsibilitie and other
with product buying – selling in e-shop www.vsmark.lt related conditions.
1.2. Customer who makes an order confirms that he agrees with the Rules.
1.3. Contract between Customer and Vendor is considered confirmed from the
moment when Customer after forming a products bag in e-shop, defines delivery
address, chooses payment method, acknowledges with Rules and presses the button
„Further“.
2. Personal data security
2.1. While ordering products in e-shop www.vsmark.lt, customer must declare
information asked during registration: Name, Surname, Address, Phone number and
e-mail address. This data is used only for order performance and problems
solving in case if they appear with product presentation or delivering.
2.2. Customer is responsible for providing the correct data during registration.
2.3. By placing an order Customer agrees that his declared personal data will
be processed for order processing and shipping purposes. Customer also agrees, that
Customer declared e-mail address will receive informational messages that are necessary
for order processing.
2.4 Customer personal data can be processed for marketing purposes only when Customer
gives an agreement by himself while filling the registration form.
2.5. By registering to the www.vsmark.lt
e-shop and ordering products
customer undertakes to protect and not disclose his login data to anyone.
2.6. Vendor undertakes to not disclose customers personal data to third
parties, except when its required by competent Government State authority in
the cases provided by the laws of the Republic of Lithuania or with the
separate written consent of the Customer.
3. Customer rights and obligations
3.1. Customer undertakes to pay the agreed
amount for the ordered products, and accept them.
3.2 Declare correct and exhaustive
information in registration form. If customer in registration form declares
incorrect, false or deceptive data, www.vsmark.lt
has the right to nullify Customers registration and delete his data.
3.2. If data provided by the Customer in registration form changes, Customer
must update the data immediately.
3.3. Customer has the right to refuse purchasing the products – sale
agreement,
in accordance with the provisions set out in paragraph 8 of the Rules
3.4. By placing an order in the e-shop www.vsmark.lt, Customer agrees with Purchase
and Sale Rules and undertakes them with established legal acts of the Republic
of Lithuania.
4. Vendor rights and obligations
4.1. Vendor undertakes to create all conditions for the Customer to
properly use the e-shop services provided by www.vsmark.lt.
4.2. If the Customer tries to compromise the stability or security of the
e-shop or violates its obligations, The Vendor has the right to immediately and
without any notice warnings to restrict, suspend or revoke the Customers access
to the online store.
4.3. Vendor undertakes to respect Customers privacy right to Customers related
private data defined in registration form and not disclose the data to third parties.
4.4. Vendor undertakes to deliver Customers ordered products to Customers
defined address.
4.5. Vendor in serious situations can temporary or fully stop the e-shop
activity without giving an early notification to the Customer.
4.6. Vendor may unilaterally change the terms of the Rules.
4.7. If Customer is not using e-shop services for a long time, his login account
can be deleted from database.
4.8 If after changing the Rules Customer continues to use the services provided
by www.vsmark.lt, it is considered that Customer agreed with the changes of the
Rules.
5. Product ordering, prices, payment methods, terms
5.1. E-shop is available for Customer to purchase products 7 days/week, 24hours/day.
5.2. Orders are received only by using e-shop www.vsmark.lt.
5.3. All product prices in e-shop are specified in euro, including VAT, and
other currency including VAT.
5.4. Customer can pay for products using payments agent Paysera services.
5.5. Customer undertakes to make a payment within 1 (one) calendar day from order
confirmation day. Order is processed only after receiving the payment for
products.
5.6. If the payment for the order is not made wihin 1 calendar day by the
Customer – The order is canceled.
6. Products delivery
6.1. Customer undertakes to specify correct and exact product delivery
place.
6.2. Customer undertakes to receive products by himself. In case when Customer
cannot receive products by himself but products are delivered to correct
address, Customer have no right to make claims to Vendor for products delivery
to an inappropriate subject.
6.3. Products to Customer are delivered by using „Lithuania post“ services.
6.4. Products are sent to Customer within 5-8 working days from payment
confirmation.
6.5. All products are sent by registered post.
6.6. In Lithuania products are delivered within 1-5 working days.
6.7. In all cases Vendor is released from responsibility for product delivery
term breaches if products for Customer are not delivered or are delivered not
on time because of Customer fault or because of circumstances beyond the
control of the Vendor.
6.7. Customer must immediately inform the Vendor if shipment is received in
damaged package, if shipment contains products that were not ordered or the
amount of products is inappropriate or the ordered set of products is not full.
6.8. Customer must provide some pictures to Vendor of damaged shipment and/or product
through email.
6.9. If products are returned to Vendor because of Customers fault with
incorrectly provided address or false address or if products are returned to
Vendor because Customer didnt withdraw the shipment from postbox within the
maximum term of its shipment keeping, Customer must repeatedly pay to the
Vendor for reshipping the products and if products were returned from postbox
or courier – Customer must pay to the Vendor for the product returning costs
also.
If Customer refuses repeatedly receive the ordered products ( it means if
Customer demands for a refund for the products ), money for order delivery
shipping to the Customer is not refundable.
7. Quality of the Production, Guarantee
7.1. All data of the products sold in the e-shop www.vsmark.lt are
indicated in the product description next to each product.
7.2. The quantities of products shown in e-shop in the
photos are not always related to the price of the products – more than one unit
of products may be displayed with the price of one product. The units of product
are specified in the product description. Colour of the products may vary
slightly depending on the monitor used by the Customer.
7.3. Vendor can give
proper quality guarantee for some separate product types, which certain term
and other conditions are mentioned in product details.
8. Product return and exchange
8.1. In
accordance with European Parliament and the Council Directive 97/7/EB,1997-05-20 , for the Customer protection
related with distance selling contracts, Customer has no right to refure the
contract if the acquired quality products were manufactured in accordance with
the Customers special requests or are clearly tailored to a particular Customer
(consumer).
8.2. Products ordered by Customer in our e-shop is manufactured by
Customers special requests and ordered product can be returned only due to
defect, in order requested details incongruity or damage that appeared during
the transportation of the products.
8.3. When returning the wrong or received defective product, Vendor undertakes
to change such product with the required product. If Vendor doesnt have the
required product, all money will be refunded to the Customer (for the products and
the actual shipping costs incurred).
8.4. If customer wants to return ordered defected products, Customer can do it within 5 (five) days from the day of products
delivery to the Customer, informing the Vendor through e-mail, attaching faulty
product and/or order shipment package pictures or video, describing appeared
problem and filling our special product exchange – return form „Product return“
in our e-shop.
8.5. Returned defective product must be in the original neat packaging,
undamaged, unused, in the same complete set as the Customer received it,
without losing the commercial appearance (undamaged labels, unpeeled security
labels and other.) While returning the product it is essential to submit a
paper (printed) document of its acquisition.
8.6. If Customer is not following the Rules mentioned in 8.4-8.5 sections which
defines product returning Rules - Vendor has the right to reject Customers
return.
8.7. If the Customer returns the product purchased with a discount, the amount
paid for the product with a valid discount is refunded.
9. Marketing and information
9.1. www.vsmark.lt can organize various discounts and special offers.
9.2. Vendor has the right to unilaterally, without separate notice, change the
terms of the discounts, as well as cancel them. Any change or cancellation of
the terms and conditions of the discounts takes effect from the moment of their
change or cancellation.
9.3. Vendor sends notifications only to the e-mail address specified in the Customer's
registration form.
9.4. Customer‘s notifications and questions must be sent
only to Vendors e-shop indicated contacts in „Contacts“ section.
9.5. Vendor is not
responsible if Customer is not receiving informational or confirmation messages
because of internet connection, e-mail service provider network connection
failures, messages being stuck in SPAM category or because of Customers
incorrectly provided data.
9.6 Customers private
data can be processed for marketing purposes by the section 2.4 indicated
Rules.
10. Final Provisions
10.1. Our Rules of purchase and sale of products are made up in accordance
with the laws and legal acts of the Republic of Lithuania.
10.2. Law of the Republic of Lithuania applies to our Rules. All issues occurred
because of the Rules can be processed by negotiation. If agreement can not be
reached - disagreements will be resolved in accordance with the procedure
established by the laws of the Republic of Lithuania.
